Is there really a class of litigators, plaintiffs, and attorneys who wake up every day filling out forms looking for a potential lawsuit? I’ve always wondered whether this is a real thing or just a myth. I’ve talked to people who have told me it’s real, so I’ve had some anecdotal proof. But today, I think I saw first-hand objective, data-driven proof. I got curious and went down the rabbit hole, running an audit on our TCPA litigator detection in Next Gen. Over the past 5 weeks, we’ve seen dozens of real phone numbers submitted through user funnels come back as confirmed TCPA litigator risks... flagged before the lead ever left the form. I want to take a moment to remind everyone that we can capture this data and block it before the lead ever leaves the system. It’s a checkbox tucked away in the phone validation settings. Turning compliance from a headache into a competitive edge
It’s crazy to think back to when compliance was an afterthought for me. GDPR? My eyes glazed over. TCPA? Not even on my radar. But once I got deep into lead gen, it hit me: you can’t scale without compliance. So I stopped treating it like a burden and started treating it like a competitive advantage. I even built LeadCapture in a way to make compliance almost push-button easy, because I never wanted to overthink this stuff again and I believe it's my duty to make this stuff easy for our customers. Here are some things to highlight (most people don't realize that LeadCapture can do all of this) - Every lead is time-stamped, IP captured, consent language locked down, and stored for 5 years. Not just in our system, but in ActiveProspect too (if using TrustedForm). Redundancy on redundancy. - An entire consent section is baked into every step submit, with pre-built templates for TCPA, CCPA, GDPR, you name it. - TrustedForm isn’t gated behind some “enterprise” plan. It’s just included, because compliance should never be optional. And it's just a flip of a switch. - Every lead is natively tagged with consent and passed all the way back to buyers and clients. Even the disclaimer text is automatically saved. Most people forget that part! And we’re not stopping here. Long term, I've got this idea for putting leads on blockchain and using zero-proof id tech to completely change how consent is captured and stored. I think this will be some disruptive stuff. But it's something we'll circle back to later in our roadmap. One last thought: these features weren’t built in a vacuum. They came straight from conversations with others. During these convos, it became clear to me that those who are winning don't view compliance as a burden, they view it as a competitive edge, because it's the thing that many people still ignore

Saw a post on LinkedIn about the recent regulation changes in Texas. Still need to dig in more, but my first take is this: if you’re capturing TrustedForm certs, OTP-verifying your leads, and using solid consent language, you should be in the clear. Here’s the bigger point, LeadCapture is being built with compliance at its core. We’re the only form/funnel builder that makes compliance this push-button easy. So if you’re already following best practices, there’s no reason to stress. In fact, while compliance can feel like a headache, I see it as a real competitive advantage.
