So this morning I woke up to a message from someone on one of my FB posts asking if I use my own personal money to fund deals. I said I would DM him and connect, I responded and shared I work with funding partners and we collaborate and bring the right capital together for each transaction.... he then writes me back that I am basically committing fraud and will end up in litigation or in "silver handcuffs"
I wanted to post his response below giving me what seems to be warnings, hoping as a group we can discuss ways to post confidently and ethically. I hope this starts a conversation and gives some direction for a call sometime...
Here is the post I received from him:
"Listen, I've seen your posts for a while and you seem like a very nice person and you aren't going to like what I am about to tell you but you need to hear it anyway because the alternative is a very painful surprise that ends up with you in civil litigation or silver bracelets.
Based on what you are posting, you are doing what's legally called, "holding yourself out as"...in this case...a private investor with your own capital.
However, when following up, you then indicate that your posts, memorialized in writing in a public domain, are not, in fact, accurate.
I can only assume Pace didn't teach you this but this is what is legally known as, "Fraud in the Inducement".
Obviously, that's something you want to not engage in.
If they are your actual liquid funds in an account you own and have custodial control over, no issues.
If not, and you are securing them via a 3rd party and brokering a transaction, which is what it sounds like, completely different story.
You are opening yourself up to both civil litigation and criminal prosecution.
Might be a good idea to clarify exactly what you are doing and your position in the transaction and relationship to any parties involved."
