CHAIN-OF-EVIDENCE Why a Chain of Evidence Must Be Established Before Any Deed of Assignment A deed of assignment is not proof of authority; it is a declaration that assumes authority already exists. Authority cannot be assumed. It must be evidenced. Before any reliance can be placed on a deed of assignment, a complete and continuous Chain of Evidence (COE) must be established. This chain demonstrates lawful existence, origin, custody, continuity, and integrity of the subject matter from inception to the moment of assignment. Without an established COE, a deed of assignment is self-referential and incapable of proving standing. The Required Order of Proof 1. ExistenceThe subject matter must be clearly defined, identifiable, and consistently described. 2. OriginThe lawful creation or acquisition of the subject matter must be evidenced. 3. CustodyAll holders must be identified, with dates, roles, and authority for possession. 4. ContinuityThe record must demonstrate uninterrupted custody. Any gap or silent period undermines reliability. 5. IntegrityAny processing, alteration, duplication, or transfer must be documented with safeguards. 6. Authority to AssignOnly once the above are proven can it be shown that the assignor had lawful standing at the time of assignment. 7. Deed of AssignmentThe deed may then operate as evidence of transfer, not as proof of entitlement. Key Principle A deed of assignment may evidence a transfer, but only a Chain of Evidence can prove that the transferor had something capable of being lawfully assigned. Conclusion Where no prior Chain of Evidence is disclosed, any deed of assignment relied upon is defective. Standing remains unproven, authority is unsubstantiated, and the purported assignment cannot be relied upon.
