Slide 2 — Why Testimonials Go Wrong 90% of compliance problems happen here • Personal health stories • Unintentional disease claims • “I didn’t know I crossed a line” Key takeaway: Good intentions ≠ compliant language Slide 3 — The Regulatory Reality • FDA & FTC strictly regulate what you say • Disease claims include: o Diagnosing o Treating o Preventing o Curing • The definition of a “disease claim” is very broad If it sounds medical, it probably is Slide 4 — The “Felt / Found / Feel” Framework This framework can work — if used carefully ❌ Non-compliant example: “I had chronic pain in my shoulder. I tried everything. Now I’m pain-free.” ✔ FDA interpretation: Treatment of arthritis Slide 5 — Making It Compliant What would make it compliant? ✔ Avoid disease terms ✔ Avoid “pain” ✔ Avoid “chronic” ✔ Compliant example: “After a car accident, I healed pretty well, but I just didn’t feel right.
