جمشید پیرفلک، عموزاده پدر کیان پیرفلک، پس از بازسازی مزار او بازداشت شد.

میثم، پدر کیان پیرفلک، کودک ۹ ساله کشته‌شده در جریان خیزش ۱۴۰۱، نوشت: «عموزاده عزیزم جمشید مولایی معروف به رایکا بدون دلیل درست یک هفته‌بد از بازسازی قبر کیان عزیزم بازداشت شد جمشید دارای دیابت هست هر لحظه ممکن است زیر شکنجه جسمی و روحی تشنج کند و به کما برود مسئولیت سلامتی ایشان بر عهده بازداشت کنندگان می‌باشد.»

دادبان تأکید می‌کند که عدم اطلاع‌رسانی درباره وضعیت افراد بازداشت‌شده از سوی ضابطان و مقامات قضایی، مصداق بارز بازداشت غیرقانونی و خودسرانه است. همچنین در صورتی که هیچ‌گونه اطلاعاتی درباره دلیل بازداشت، اتهام انتسابی، محل نگهداری و وضعیت سلامتی فرد به خانواده او ارائه نشود، این اقدام می‌تواند در عمل مصداق ناپدیدسازی قهری باشد.

Jamshid Pirfalak, the cousin of Kian Pirfalak’s father, was arrested after his grave was renovated.

Meysam, the father of Kian Pirfalak, a 8-year-old child killed during the 1401 uprising, wrote: “My dear cousin Jamshid Molaei, known as Rayka, was arrested without any valid reason a week after the renovation of my dear Kian’s grave. Jamshid has diabetes. He may have a seizure at any moment under physical and mental torture and go into a coma. The responsibility for his health lies with the detainers.”

The judge emphasizes that the failure to inform the officers and judicial authorities about the status of the arrested individuals is a clear example of illegal and arbitrary detention. Also, if no information is provided to the family about the reason for the arrest, the charges against them, the place of detention, and the individual’s health status, this action can in practice be an example of enforced disappearance.
