The judgement has come through
Judgement has come from and my appeal on costs failed as it stated they were awarded costs contractually. Be warned if going to court it landed me with £23k bill

@Peter Wilson this is all very interesting, but again another challenge and an appeal to the high court would potentially put me at risk of more fees if they win. Unfortunately I’m not in a financial position to take that risk on. This has wiped out my savings as it is. In principal this is a really informative group but in practice when you’re infront of a judge and barrister such as my case they over complicate things and talk down to you because you’re not part of their coup, resulting in me being fleased for an additional Ā£15k on top the the original debt. I can not take that chance again and end up with Ā£50k plus worth of debt
Court Documents.
Hi Guys, A lot of you are asking for the court documents. I want to be clear and honest, I was confident going into this case however on reflection i feel that my paperwork was lacking and wrong. I was not prepared for how technical the court got with their communication, i'm dyslexic, i'm not using this as an excuse but when it came to costs, both the judge and barrister went over my head with their conversation with numbers and brackets etc to work out the costs, from what i remember the barrister was something like a band A so costs should be higher. I've attached the court letter stating it was on the small claims track, I was the claimant and put in 5k claim. They were the defendant looking for the initial free of just under 10k, interest at 4.3% totalling just under 5k then they submitted costs for 20K. Ive attached mine and their court bundle, their court bundle is easier to read in a pdf document, i've also included their skeleton argument which i got the day before court, their case law and authorities. I have 14 days to pay the 23k costs, and unfortunately i'm considering it because i cant afford a CCJ due to it messing up my partners future plans. She's been there for me throughout all of this and i feel to selfish if i now impede her. I'm luck enough to has assets to sell (Car and Caravan) which i believe should settle this. Obviously this is a massive blow, but i'm worried that if i try again i could end up with 50K debt to owe and honestly that terrifies me.

Lost at county court
Lost at country court, Azzuros turned up with a barrister that steam rolled me over. The judge sided completely with them and I’ve been ordered to pay 23k on a 9k debt due to excessive fees. I tried a right to appeal but the judge stated he will lot grant it. So what now?

@Peter Wilson no mention of that, from what I understood it was because it was a business debt initially and from the contract with Capital on tap it states something along the line of they can impose unlimited legal costs. They went heavy with the personal guarantee and the assignment of notice, which satisfied the judge. They disregarded the fact the SAR was a day late and that it entitled to no compensation because harm wasn’t caused and it’s a technicality. They also dismissed the harm caused by inferring that it was the debt collection that caused distress not the data loss. When the judgement letter arrives I’ll share that too, but again I agreed in court that the personal guarantee does say my name, I feel they walked me into several well phrased questions that I couldn’t argue without looking unreasonable and with the cost thing in the back of my head I didn’t want to appear as unreasonable.

Im in court tomorrow against the debt collector Azzuros Associates and their legal team DTM, Unfortunately it is going to county court and not clemency court as when i prepared this case i was not aware. wish me luck šŸ˜…

Quick update
I’m just over two weeks out to going to court with Azzuros legal team on a business credit card debt with a personal guarantee signed. Today I’ve posted off my court bundle to both the judge and their solicitors. They have made a couple of mistakes such as responding to my SAR 1 day late and I feel pretty comfortable understanding the angle of the strategy to take, well enough to defend myself in layman terms to the judge. However that’s my concern now, the judge. If they reject the argument of the deed of assignment and side with the debt collectors that this is a stalling tactic then the whole case will fall apart, any advice on how to avoid this? I’ve been pretty clear in my skeletal argument about focusing on the deed of assignment and that it is a vital to the case regardless of debt being owed. I’m not arguing the original debt I’m happy to say I owe that in court to capital on tap just not Azzuros. I just don’t like the idea of being rail rolled in court now that Azzuros solicitors has a copy of my court bundle so are going to look at how to defend against it.

@Matt Rowlands I’ll see how this goes, my skeleton argument is pretty bomb proof with how Azzuros have conducted themselves, but you never know how the cards will fall
