I have been listening to the MEE walkthrough regarding issues of false imprisonment and vicarious liability (Paul & Mom v. Funworld). Im confused by when the issue of vicarious liability is addressed.
In the fact pattern the first call of the question is, Did Funworld falsely imprison Paul? In the Legal Problems of the Point Guide it asks, "Could a jury properly find that Employee falsely imprisoned Paul...".
And even though the walkthrough video discusses vicarious liability in relation to the first issue, the MEE Explanation and Analysis Point Guide did not go into vicarious liability until the second call / Legal Problem. ("Funworld was negligent because Employee failed to take action..." / "Could a jury properly find that Funworld was negligent because Employee failed to take action...")
Therefore, I'm confused why vicarious liability isn't addressed in the first call but is addressed in the second and when should I discuss certain issues in order to conserve my time in writing out my MEE answer?
Thanks in advance for any help!
