Filing an N4 and an N5 When a Tenant Owes Rent & Utilities
Recently, I spoke with a Landlord whose tenants owe her rent and utilities. I had always been under the impression that utilities would also go under the N4, but when I started digging into it, I found that the factual answer was the utility portion has to go on an N5. It was under Reason 1: for substantially interfering with the landlord’s interests. What Happens When A Tenant Dies
Recently, I spoke with a Landlord whose tenant had passed away. They were unsure how to proceed. The death of a tenant is covered in section 91 of the Residential Tenancies Act, and it states that after 30 days the tenancy will end if there are no other tenants. The Landlord must provide reasonable access to the executor or family member responsible for disposing of their belongings. After 30 days, the Landlord can dispose of the tenants belongings. However, the estate or executor will have up to 6 months the to make a claim for the proceeds of the sale of those possessions, or to ask for any of the possessions the Landlord kept. Bill 60
We are all excited about the changes announced with Bill 60 and the fact it received Royal Assent. That said, the parts we are concerned about have not come into force yet. I’ve attached a quick reference to show what’s in force and what is still awaiting proclamation by the Lieutenant Governor in Council.
