Recently, I spoke with a Landlord whose tenant had passed away. They were unsure how to proceed.
The death of a tenant is covered in section 91 of the Residential Tenancies Act, and it states that after 30 days the tenancy will end if there are no other tenants. The Landlord must provide reasonable access to the executor or family member responsible for disposing of their belongings. After 30 days, the Landlord can dispose of the tenants belongings. However, the estate or executor will have up to 6 months the to make a claim for the proceeds of the sale of those possessions, or to ask for any of the possessions the Landlord kept.
