PIP
Does this trust cause any problems for my son? He is in receipt of PIP (not means tested) and UC he's not able to generate an income but will be left 50 percent of property on my death, Does he or I need to inform HRC regarding the trust? And is it him who should fill in the RX1 form? Once the trust has been created? I'm concerned about the vultures circling him, he wont be able to cope - My sons are going to be Trustees and Beneficiaries - I just want to ensure they don't end up homeless or stop my sons benefits - it's his only form of income to survive

@Dave DimeBar I'm not, I'm referring to the private trust in equity law that is part of the truth bundle in this group! My brain scrambles literally when it comes to my son 😔

@Melanie Lambert Hi - Does one have to be on the electoral role for this to be water tight? I own my property outright, need to secure it for my sons, but I'm not on the electoral role, Im wondering if this could be used against me?

aww the chatbot is spinning me out - it just directs me to seek professional advice and get tax advice and see a solicitor - non of which I can afford! Is this because my son receives PIP and UC? I really would rather not! Then I'm instructed by grok to set up a disable persons trust with a court - see I hit obstacles like this and don't end up up doing anything! Too many obstacles - too much much conflicting information, makes my brain shut down! I need step by step sound advice for setting up a trust that accommodates my son who is not able to work and relies on his benefits, I cry every time I start looking into it!

what's the view from the group on maintaining the dormant limited company (used for the HMLR trust forms) ? I'm not willing to give up the data on me, so on balance its not worth keeping the company going. Shut it down? Views?

Disabled Off-spring
The more I dig regarding trusts, the more frustrated I feel - there are too many "rules" and "conditions" related to trusts and tax! The game changes again, it appears if an off-spring is in receipt of disability benefits! All I want is to die knowing my sons can have safe shelter and not end up on the streets! I weep everyday in fear of their future - and that the evil council will find a way to take this property from them! My brain appears to have imploded with it all - I'm going back and forth with this, and end up doing nothing because its too stressful - I can't get a handle on it

Does it have to be a Jersey trust? I've decided I'm using a solicitor, I can't do it! My brain shuts down, can I still keep a private trust in equity law using a brief? And recommendations? Please 🙏 thank you 🙏

@Checkmate Attendee I know they will "tell" me, but I don't have to listen or comply! That's why I need a brief who will do what I want them to do! That's what I'll be paying them for, to create what I want 🤔 I'm not putting up with any of that! Starmer is closing in on private equity 🤔 not sure if that means trusts, but it feels like nothing is safe, anywhere, they can change the goal posts at will which is another worry! My son won't be able to cope with a Jersey trust, he wouldn't be able to deal with the duties
