Beware of the TCPA Act….

On January 27, 2025, the Federal Communications Commission (FCC) will implement a new “one-to-one” consent rule under the Telephone Consumer Protection Act (TCPA). This rule mandates that businesses obtain individual prior express written consent from consumers for each specific seller before making telemarketing calls or sending texts using automated systems or prerecorded messages. Previously, companies could rely on a single consent covering multiple sellers, but the new regulation requires separate consent for each entity.

Professional litigators will have a field day with this one. Using a dialer and making Cold Calls will be greatly disrupted.
