Property Lien
@Michelle Adams Good morning, Hope your day is off to a great start! I have an issue in Texas that I’m dealing with….Im an heir to a small estate of about 25 acres….one of the other heirs had a manufactured home on the property using less than an acre. They let the house go back and some way the mortgage company has placed a lien on the entire estate. I spoke with them explaining that it was heir property and asked if they did a title search and that a manufactured home was personal property, not real estate…. Needless to say they hung up on me after that and I haven’t been able to get in contact with them, but I had no idea it happened years ago and I don’t want it to hit the 10 year mark. Is there any advice you can offer from a Title perspective because I feel like something was terribly wrong here.(maybe even fraud) I’m in the process of hiring an attorney, but wanted to see if you had some insight.

@Rafael Davis It sounds like the mortgage company either has, or is planning on suing the owner of the mobile home and obtaining a money judgment against them. Do you know if an abstract of judgment has been recorded in the county where the property/mobile home owner are? They can attach this to the person and by extension any real property they own WITH THE EXCEPTION of a property that was homesteaded. So if they did in fact get this monetary judgment, the lien they placed on the property is ONLY against their undivided share of the property. It does not encumber any of the other owners’ share (so there’s really no fear of foreclosing on the entire property). If they wanted to foreclose on only the portion the mobile home owner has, they could go through the court system to have their portion partitioned but it’s a tedious process and most buyers wouldn’t be interested in purchasing an undivided interest in the property. Sounds like an inconvenient situation but not one that jeopardizes your interest in the property. Depending on the lien amount, you could consider having the person with the lien gifting you (and any of the other owners) their portion of the land in exchange for paying off the lien. Just a thought.

@Ruben Austria it sure is. I guess at our local elementary school over 100 kids were absent this week. It isn’t going away quickly either.

I hate to say it but, don’t just take your clients word for it. There have been numerous times we have found liens that either the borrower/seller either didn’t know about or thought maybe the title company wouldn’t find the lien. Needless to say it impacts the close of title and is easier to fix upfront!
