What top 3 questions you ask a probate attorney
I may be bringing some legal professionals to future calls. What top 3 questions would you ask if I was paying for your consultation?

My 3 Questions are: 1) How do you handle it if there are 3 heirs and one does not want to sell? Says that he would buy it himself instead of selling it for that little? And then stalls and does not buy? (I am interested in buying at the right price) 2) The seller claims that title is good and ready to close & that everything has been worked out with other heirs & then in a title search, it turns out that a sister passed leaving two grown adults who were not notified & claim an interest in the property & now everything has stalled because more heirs means more people having to agree to sell & more indecision around, well, we might want to keep it ourselves ? 3) We have bought properties which had multiple heirs & had real estate assets which needed to be sold to settle the estate, with one holdout who either refused to sell or wanted an unreasonable amount? We have bought out the rest of the heirs & filed a suit for partition & is there ANY way of knowing how much this process “Might Cost” before we close & take this risk & are “flying blind” because the attorney has often wanted to “just bill by the hour?” Open ended? And we said NO, and have been able to negotiate a mostly flat fee with some reasonable additional charges for court costs & so forth.

A friend reached out who inherited three properties in Freestone County/Teague, Texas. One of them, a single family house + an adjacent 1/1 was under contract to sell to a neighbor in February. Title underwriters called out a string of unresolved probate concerns and were unwilling to insure. That sale fell through as a result. Property details: - - Main house (brick): ~2,700 sf, 3 bed / 1 bath, two-car garage, built 1955, newer roof, 95% rent-ready. Potental rent = $1,500/mo - $1,600/mo - - Second house (white frame): ~800 sf, 1 bed / 1 bath, needs full rehab (ceiling collapse, door issues). Potential rent = $900/mo - - County appraised value (2026 CAD): $201,504. 2025 property tax: $3,294/yr. - - Comps are thin... $125K - $150K ARV - - Both structures are vacant - - $30,526.27 deliquent property taxes owed - - No debt incumbrence My friend wishes to sell the above property and keep the other two (but I think these could enter the discussion at some point). One is a vacant auto repair shop in town. The other is a large land parcel adjacent to high end homes. $38,000 in deliquent taxes owed on the other two properties. Contact me if interested.

I am interested Marco, I have resolved title issues on properties like this in the past. At the moment, I am in Houston, about two hours away. Have bought over 300 properties all over Texas, with over half being in smaller towns that no one else was willing to touch. 832-766-6997 text is best.

@Carolyn Plassman makes some good points! And I just invested 3 days driving tax liens all over the state of West Virginia, these are OTC and (we as a group I belong to) have done very well with them & there are all kinds of opportunities that tie in with “Dirty Titles” and appreciate Elis & everyone here sharing in this group!
