Language Capacity Declaration Sometimes we receive it like this: 👉 Signed ✔️ 👉 But the text is NOT handwritten ❌ Even though it’s signed, that’s not enough If no translator is needed, the signer must: 👉Handwrite the full statement (yes, word by word) 👉 Then sign. Both steps matter 👉 Have you come across this one before? 👀

This closing mistake delayed funding… who’s at fault?
We had a closing where the signer needed to sign in two different capacities: ✔️ As President of a company ✔️ And also in a personal capacity The notary completed the signing…but only captured the signature as President. The personal signature?Missed. The documents had to be corrected. Now here’s where it gets interesting… At The Closing Signing Service, we also reviewed the documents and we didn’t catch it either ;( When we reached out to the notary to fix it,they agreed to go back, but requested an additional fee. 💡 Here’s the lesson: Closings are not just about “getting signatures.”They’re about understanding how and in what capacity those signatures are required. This is where true professionalism shows. ✔️ Notaries must be detail-oriented ✔️ Signing services must have strong quality control ✔️ The priority should always be protecting the client experience Now I want to hear from you 👇 Who do you believe is responsible in this situation? And be honest… If you were the notary, would you charge an additional fee to go back and fix it? ✔️ Yes✔️ No✔️ Depends At the end of the day, this is exactly why I’m so passionate about training notaries…because the better they perform, the better we serve our clients. And of course, we got it resolved, the documents were corrected, and the transaction successfully funded 💪

I think both share responsibility however I would not have charge a fee for my error.
POA signatures… let’s talk about this one 👇
We keep seeing the same issue come back: The document shows something like: “John Doe by Jane Doe, his attorney-in-fact” But then the signer either: 👉 Signs just their name 👉 Signs below the line 👉 Or doesn’t include the full format And that’s where the problem starts. The signature should actually look like: “John Doe by Jane’s signature, his attorney-in-fact” Not just Jane’s name… not under the line… but the full format as shown. It might seem like a small detail, but this is one of those things that can easily get documents rejected. Quick tip: Don’t assume the signer knows how to sign under POA, guide them through it every time. 👉 Have you ever had to correct a POA signature at the table? What did the signer do at first? 😅

I had a POA yesterday. It was maybe my second one. An issue I had with mine was certificate wording. It had the wording for the person with the POA but not the attorney in fact wording so I had to add it.
