🚨 Shopify Payments & US LLC Issue
Hey everyone 👋 I’m facing a roadblock with Shopify Payments after their new merchant verification update. I have a US LLC but I’m a non-US resident, running dropshipping stores with no physical operations in the US. 🏬❌ Shopify is asking me to prove “substantial operations” in the US (warehouse, office, employees, etc.), otherwise payouts stay paused. Has anyone here successfully solved this situation? Any workaround or alternative you recommend? 🙏 Thanks in advance.

@Paola Moreno Hey Paola!, so basically if Shopify ask us for proof of “substantial operations” in the US and we get a unique address verification in the US, are we now engaged in trade or business (ETB)? Or everything stays the same?
Shopify Payments, 1099k, W9 W8
I managed to activate Shopify Payments with the simple EIN, as a foreign owner single member LLC. However, after a year they told me that they have to create the 1099K file and asked me to fill out the W9 form. What do you recommend? 1) Try to push to provide the W8BEN form (I do not want to declare with the W9 that I am a US person), and ask them not to send 1099K to the IRS? However, in this case they will probably close the Shopify Payments account that has good fees compare to other processors. 2) Do not worry about the 1099K, simply fill out the 5472 as usual, and fill out the w9, w8? However, is there any need for some precautions for the 5472 form in this case? Should a note be added that specifies not to consider the 1099k? In essence, is it better to avoid if possible that payment processors send 1099k to the IRS? Thanks

Hey, I know its been awhile, but how did you end up managing this situation?. I've also activated shopify payments on 2024 only with EIN (No ssn/itin) as a foreign owned LLC and at the beginning of this year, shopify sent me my 1099k. They didnt ask me to fill out any W9 tho, but just for precausion I've asked them to fill my 1099k under my LLC details and not under my personal details and they did 🤷‍♂️ I've been a bit worried since then hehe
US-based nominee director for merchant accounts
Hey guys, I'm an Australian citizen who has recently setup a single-member Wyoming LLC. I've got the EIN, bank account, registered agent and company docs. As I want to run a subscription offer on my ecommerce business, Stripe isn't the best option and I'm looking for a high-risk merchant account. Unfortunately, most US payment processors also require a US-based director that can act as the signer to help me get US-based payment processing (merchant accounts). I'm looking for a reputable service provider that can offer me this director, along with a Nominee Director agreement (NDA), Declaration of Trust and any other legal docs that can help. Thanks!

Shopify Payments for foreign SMLLC
Hi everyone, hope you are doing great. Has anyone here been able to set up shopify payments for their shopify store? (I’m talking about the payment processor that shopify gives by default and is powered by stripe) for what I’ve seen lately, for foreign LLCs, apart for the company information they also ask for a SSN and maybe proof of a business address in the us, how did you went over that?, is ok to put my EIN where they ask me for my ssn? o should I get an ITIN? Thank you

@Adrian K Thanks for your advice Adrian!, Yes, I’ve been considering using authorize.net or find a way to use Stripe because shopify payments has been putting many barriers for non us people
LLC Formation
Good day. Recently I opened and LLC in Delaware. I got my EIN a few days ago, also I submitted the BOI report, along with the ProForma 1120 + 5472 forms. Is there anything else that I need in order to start "operating" with my business? Are there any other forms that need to be submitted to the IRS or any other legal entity?

For my knowledge I think that would be all for now, make sure to have your LLC operating agreement and register for sales tax if you sell physical goods. Would be great if James answers your question because I’m not 100% sure either.
