Intestate Probate, 4th Heir Excluded - PETITO
Property - 3/1 house in California, 100% equity. As-is value 600k with 100k in tax delinquency. Equity - 500k net equity after taxes. Title - Still in father’s name. He passed in 2019. Wife predeceased him. Open probate for 3 years, not yet finalized. Interest - 4 heirs total. 3 heirs from the first mother are aligned and working the probate together. The 4th heir is from another mother and has been completely cut out of the process. She isn't mentioned in the probate docket. Threats - I have only been able to reach the 4th heir. She’s open to working with me but needs to prove she’s the biological daughter. The other 3 have been hard to reach. Opportunity - Buy the 4th heir’s interest and step into her place. Negotiate with the 3 or litigate if needed. Questions - #1- Is this a deal you would get into assuming the 3 heirs will fight the 4th heir interest? #2 - What would be a reasonable offer for the 4th heir for the 125k interest (500k/4)?

@Ellis San Jose how do you identify all claims against the estate if medical only pops their head in the middle of probate? I ask regarding any future deal we are considering
Squatter - cash for keys
I have a property in Sacramento, CA. Picking it up for 27.5k We are about 1-2 months before the sheriff comes knocking. My Probate Professional Fiduciary said we are clear to close now. Should I acquire it the moment they are out or acquire it now? Every time I’ve tried presenting a cash for keys scenerio, the squatter has been high as a kite and the conversation gets nowhere. I plan on trying one more time since she’s about to get released from jail. I have a short window before she starts abusing again. Any advice on how you guys frame cash for keys? I have to move quick before it’s assigned a Recievership. Thanks!

I have a lead in Atlanta, GA 30349. Brother owns 50%, sister owns the other 50%. As-is property value is $120k.. ARV for you flippers out there $220k-$230k (budgeting $50k in rehab). Brother reached out to me and wants to sell his 50%… sister does not want to sell. Property was inherited from their father, will was already probated 5 years ago, and now both him and his sister are on the deed with rights of survivorship.
