California Probate Code you should know
Before probate closes, an heir/beneficiary doesn't own specific real property they hold an expectant, contingent interest in the estate (a right to eventual distribution). You can't get a deed to the house itself yet. What you can acquire is an assignment of the heir's beneficial interest basically, you step into their shoes as the person entitled to whatever they would have received when the estate is distributed. This is done through a private purchase/assignment agreement, sometimes coupled with a "notice of assignment" filed with the probate court so the personal representative and court know to distribute to you (or your entity) instead of the heir. The governing statute: Cal. Probate Code § 11604.5 This is the key law you need to know cold. It applies specifically when a transferee acquires a beneficiary's interest "for value" (cash or other consideration) and it applies with extra scrutiny if you, as the buyer, regularly engage in purchasing beneficial interests in estates for consideration

Thanks for your this! When have you seen this kick in - I’m assuming this is somewhat of a protection against unjust enrichment? The way it’s written is a little confusing, as if they are treating any proceeds or property resulting from an assignment of interest from beneficiary to transferee is “paid” from beneficiary to transferee?

Forgot to post the code: (h) The court may refuse to order distribution under the written agreement, or may order distribution on any terms that the court considers equitable, if the court finds that the transferee for value did not substantially comply with the requirements of this section, or if the court finds that any of the following conditions existed at the time of transfer: (1) The fees, charges, or consideration paid or agreed to be paid by the beneficiary were grossly unreasonable.

My questions typically go t towards how experienced and comfortable they are in handling adverse situations, forcing sales/partition through the probate, strategies towards removing occupying heirs or unauthorized occupants, and if they are willing to work on contingency for a % of proceeds recovered (if I anticipate it will go long).

I just had lunch with an owner of a local title company. She is going to introduce me to their legal department. My question was “What happens when a file can’t close because of a title issue and sellers can’t afford to pay an attorney?” I also have a lunch scheduled to with the attorney they refer for all title issues.

@Ryan Nickel I would say focus more on title companies that wholesalers / investors work with. It's the same thing in the DC area - most stuff is buttoned up, but the ones that are already distressed and being bought at a discount by traditional investors have a higher likelihood of having these issues. Still, it will be much less in affluent areas.

Chris Burns (Pickledeeds.com / Pickl.Fund) Hey guys! I am based in Washington, D.C. (soon to be Northern Bay Area in California). In the last 13 years, I've done a little bit of everything in real estate, but have always been drawn to the niches of the DC market (TOPA, condo foreclosure, quiet title, etc). In 2024, I took some coaching from Logan Fulmer and launched Pickl to pursue curative opportunities at scale. We currently focus mostly TX, but also have some projects in DC, MD, and VA as well. I also run Pickl.Fund to provide equity based funding to help other operators who have great opportunities but are short on cash to execute them. My biggest obstacles are: 1) Figuring out the 80/20 with blending AI and human involvement with data collection, automation, and research. In essence, what's the best balance for using AI and my researchers for the data we use to pursue opportunities? 2) Learning the nuances and niches of the CA market (my new backyard) 3) Figuring out faster ways to onboard team members to be productive for our company in this niche without overwhelming them.
