Update - Wholesaling Laws in Alabama (2026)
TL;DW: Alabama SB 228 (effective 5/9/23) - you have to disclose in writing to both seller and buyer that you're intending to wholesale the seller's house; you have to disclose in writing to the seller three business days prior to the assignment agreement becoming effective; and you have to follow new rules regarding the filing of memoranda of contract (i.e., "clouding title"). Failure to comply with this law will result in a Class C misdemeanor and/or civil liability of up to three times your assignment fee. Failure to file memos the legal way can result in a $10,000 fine per infraction. Alabama SB 246 (effective 1/1/26) - if you wholesale in such a way that it meets the standard of "brokering real estate" as defined by the Alabama Real Estate Commission (AREC), then you'll need to get an Alabama real estate license. Rough guide: if you're doing more than 5-10 assignments a year in the state, you might as well get your license.
