Special appearance What that procedure is called When you use the IRS’s own records, procedures, or testimony to challenge the charge in court, you are challenging the validity of the assessment through judicial review of an IRS determination. Depending on posture, it is commonly described as: • Assessment challenge (attacking whether the tax was lawfully assessed) • Challenge to presumption of correctness (forcing IRS to lay a factual foundation) • Evidentiary challenge to the assessment (using IRS records/witnesses against the claim) If done before payment → it is part of a deficiency proceeding. If done after assessment/collection → it occurs in a Collection Due Process (CDP) case or refund suit. What you are doing in plain terms You are turning the IRS into the proof witness: • Demanding the administrative record • Forcing production of assessment certificates (e.g., Form 23C/official transcripts) • Testing whether the IRS followed statutory procedure • Attacking the presumption of correctness when records are incomplete or defective If the IRS cannot establish a proper assessment, the charge collapses. Where this happens (courts) • United States Tax Court – deficiency cases (pre-payment) • United States District Court – refund suits (post-payment) • United States Court of Federal Claims – refund suits (post-payment) Where the rules are found 1. Court has begun!!!
I have always been one to express myself, and although I have often been misunderstood, I have benefited from doing so. I believe if you don't speak up, you've already lost, so I will always express myself...like it or not. I did not know that the administrative process was a thing until joining this community, and I rock with it...going to court starts here on the paper. I am currently going through the administrative process, and here is the scenario: an original loan was transferred. I did not know this, but once I was notified, I knew it was the best thing to happen. Why, you ask? Because processes & rules need to be followed (usually ones we are not aware of, so lack of knowledge is how we perish). 15-day required notice (disclosure) by the seller was not sent, and I know this from the dates on their notices. They transferred my banking info without my permission, violating CFPB Autopay rules, NACHA rules, and the FTC Unfair Practices Act. They notified me after the transfer took place, which is illegal under RESPA §6 (12 U.S.C. 2605). The letter was signed not by a real person, so there was no responsible party, no bond, no oath, and no authority; this made it a noncommercial piece of mail with no liability. That is just for starters; there is so much more to unpack... this is what I am working on. I will be getting them notarized and mailing all three packets today; the court has begun! I add receipts in a bit.

Despite the day to day distractions and appointments I chose to put me first. I rescheduled an appointment to meet the times offered to get my fingerprints done instead of putting it off until tomorrow I did it today. One step closer than being stuck in the same spot. Here's the receipt, everytime I execute, I win! 😎
