🚫 AI and Copyright: The Bottom Line
A user recently asked: "I used Mystic to create a design with a famous cartoon character. Is it still subject for copyright?" 🤔 The answer is simple: Yes ✅ Mystic is a powerful tool, but it doesn't change copyright law. The original creator of that character, slogan, or logo still holds the rights. When Mystic generates a design based on that prompt, it is creating a derivative work, and selling that without permission is still infringement and the rules of intellectual property still apply. To protect your store from legal issues and platform bans, always stick to original designs you've created yourself or content you have a license to use. I've done a deep dive on this. But also don't take this as gospel. I'm only sharing what I learned and go by. We are all on our own but it's really important like Daphne said. And TM laws can change. Every thing is copyrighted. If I say something to you that's funny enough for you to use it, ask. If you hear a sentence in an interview that cute enough to put it on a tee, its copywrited. Chances ate however the interviewee could never claim a copywrite to it so I'd use it is I wanted. (Unless its a line from a movie "I'll have what she's having" for example, or song, poem, not 75+ yo book. Esp if officially copyrighted. Paid for. Trademark is different. Its not simple to get a TM. And there are categories. I wanted to use a friends company name on a tee for here. It contained the word "sacred." I was shocked to find out that the word "sacred" is trademarked for teeshirts. (Probably not for video games. There are categories.) And sometimes the TM is the font. Its ok to use another font sometimes. I'd say get acquainted with the TM website. However, you can use the Trademark symbol on anything unique you conceived of yourself. You don't even have to be actively applying. But, you can not use ® (registered) unless you have paid for and gotten approved. Worth doing a deep dive. Due diligence! Don't assume because it's on a public image site, its good to go. Anything resembling Mickey Mouse ears, on any animal ot thing, is a breach and Disney can and will sue. Taylor Swift also holds tons of ™. And both are litigious. Be very careful of using anything about our current prez! Esp likeness. Or anybodies face. And yes, "I'll have what she is having" IS Trademarked. I had a shower conceived phrase that was great, I thought. For a lark I looked it up on the TM website. It was trademarked! I thought I had created it. I was shocked! We are each responsible for doing our own research. Don't quote me on anything. (See, just saying that, or saying "off the record" as another example, protects someone too. You don't have permission to use it.)
What's your approach to product images and gender?
Besides the standard ghost mockup with my design, I also include two extra images: a close-up of the print and a lifestyle mockup, so customers can see how the product looks in real life. Since most of my products are unisex (tees, hoodies, tanks, etc.), I usually need two lifestyle images—one featuring a woman and one featuring a man. Sometimes, I even split these into separate product listings for each gender. I’m curious about your approach since there are many different ways to handle this.

I'm still at the designing stage. I've done a few mock-ups but mostly on designing. For me, DEI still exists. So I am and will continue to be all inclusive. All races/cultures trying to be without generalization about any specific group (ie. Paying attention that the extra articles in the mock up are not "mocking" esp in ways I never thiught of? Male, female, and more neutral if I can find good images. Not using the American flag on anything esp since buying overseas could be a thing I add Later. I will also have my designs revamped slightly for an LGBT section with rainbow flag if it works? I may also eventually have some designs that are for specific disabilities (that's my Niche) and in which case I will at times include the ribbon for that cause? And sizes. Models are usually thin. If I'm offering 3, 4, 5x, I want at least one model who would wear a larger size. Because I also use unisex, I don't feel the need to have women's/mens separate? I may however offer a couple of different Tees esp since with disabled people have different needs. More tapered, boxy, organic. More $ for organic, less $ for perhaps the 5000 for those with a smaller budget. I have not set up Shopify and I don't know how difficult that will be so its maybe. Or I add it later just to get my store open! I don't know if that helps. As a disabled person with sometimes clothing issues, sensitivity, esp within disability culture is necessary I think. Find an image you love (e.g., from Pinterest, Etsy, Redbubble or an already existing image you generated within Mystic POD). 2. Cool. The image looks way too big tho so I guess we would have to specify. Part of an issue I'm having is a sleeve issue. It seems mock ups, even in printify do not show the true sleeve length ans tightness as in a lineup of a specific tee, the sleeves are not the same. My niche needs longer and not tight sleeves but not big boxy streetwear. Because I can't trust images, I need to order samples. So, with this mock up, its a generic Tee your customer would see that may or may not be the same as the one they buy? Did you tell mystic what brand of tshirt you are offering? Curious.

@Daphne Fernando I was just pointing out to probably not use it as a mockup on your site or in an ad. Its what people think they will get. And O am having the sane issue with printify etc. That's all.

With the right program, you can design Tees without being an artist. I don't draw well enough to play hangman! A creative mind is the most important.
