Informed Decision
I was recently granted SSDI, but they set an onset date two years later on what I submitted. I called SSA and asked for an explanation on their date selection. I understood that if they changed the date, their rules require a pretty detailed explanation and I got none. I was told by the SSA rep that I can either accept the date they selected or I can appeal. I would just like to know their rationale for that decision so that I can make an informed decision on an appeal. There were no events, tests, or new diagnosis anywhere close to the day they selected. How can I obtain that decision rationale without having to pay $82 to sift through things that I probably already have.

Can’t wait to see Dr Ed’s response, or anyone else’s. Great question Ken. Been in a similar position. I believe you have a right to review your file according to comments by Ed on a different post. Did anyone reply DM to this? Beth

Ken, I believe the charge for a copy of your entire file, not just medical documents should not apply, or be waived, if the information is needed for a claim. Same thing for copy of itemized earnings record, fee is not charged if the request or need is part of an ongoing claim.
Help with SS
My friend is disabled & was receiving SSA & disability which was $1012.00 p/month. They took her disability away ($700.00) because they said her husband makes to much. So now she receives $312.00 p/month. Her husband makes only $1.00 more than min wage which is $15.00 p/hr. He does not give her any money or access to the money from his paychecks. She needs things & does not have enough to live. What can she do??? She was born in 1961. Please help. Thank you so much.

Erroneous SSA approval
I applied for SSDI in July. All my documents, mailings, and uploads were marked with Compassionate Allowance Program / ALS. I received a letter from the SSA in early September that regular retirement benefits were approved ???? I already filed an online appeal, but am running out of time to lose my health insurance coverage (Cobra / ACA way too expensive). Any advice or help to quickly get this wrong decision rectified? Thank you!

Walter, was your original claim for disability, survivor, SSI, or SSDI? Or? And what age were you in July? The denial letter should state the type of benefit they processed, whether or not it is what you intended. Let us know Please. Beth

@Ed Weir wait, now I am more confused. If on SSDI you already have Medicare, right? So at 65 an SSDI recipient can get a Medicare supplement not available under 65. But is it 65 or FRA (67) that SSDI converts to retirement meaning no more CDR or SGA earnings limits, if relevant. Please clarify

@Ed Weir Thanks for that helpful response. Please tell, what is the best simple non adversarial recourse when one has been told No, you cannot apply, repeatedly over many years. Please note that when the claim was finally “taken” we were advised by the 1 800 agent to document this and request an earlier protected filing date. Five months after the claim was started on the phone, we were given a phone appt with a separate agent at the FO, not assigned to the claim, who responded by separate call back to us later that day that “No. You cannot ask for that. Request denied”. The letter later sent documenting that appointment was only about not being eligible for SSI, even though no application for SSI was requested or discussed. How do we fix this issue (as well as several others) that were specifically asked about in the first appeal and were all entirely ignored once the claim was approved. You cannot appeal a closed claim has been the answer, and the attorney hired after the appeal was filed withdrew immediately at initial yes, even before the benefit was calculated. We are stuck. Have studied the POMs need your expert guidance.
MEDICARE
When someone turns 60 and is receiving DWB benefits, I know it transitions to Regular Survivors Benefits. Does Medicare also stay with the person at age 60?

Is it at 60 or at 62 that it automatically switches? And Why? It seems very unfair arbitrary and capricious as SSDI does not become a retirement benefit until 65, or is it at FRA? This seems punitive with no legitimate purpose or rationale other than “policy”.
