Effective September 1, 2025, Texas has amended its Telephone Solicitation Act (TTSA) under SB 140. The amendment expands the law to cover text marketing and creates serious new obligations for businesses. Here’s the breakdown: Who must register? Any business marketing to Texas residents by text or call. What’s required? • Annual registration with the Secretary of State • $200 fee per business location • $10,000 surety bond (or equivalent) • Appointment of the Secretary of State as Agent of Service Exemptions? Yes—publicly traded companies, certain nonprofits, schools, food sellers, some brick-and-mortar retailers, and more. The risks of noncompliance are severe: Immediate consumer lawsuits (no need to report to an agency first) Civil penalties of up to $5,000 per violation Treble damages + attorneys’ fees Class A misdemeanor charges for unregistered solicitations 👉 If you market to Texas by text, you must act before September 1, 2025. Hey MGL community! :) If you are using the Engager buddies option, here a quick tip on how to use this feature- 1) Be thoughtful with your comments- If you are in an MLM please know that some of your buddies might be also be in an MLM, and if they are in a leadership position- and you are leaving a comment on your post requesting information or eluding to anything that could possibly suggest they are using the products or interested it could jeopardize their status with their company. As far fetched as this may sound- it's true. Many companies will pay attention to their leaders, or others are watching their activity and will turn them into compliance- which can lead to them getting their account shut down. So instead of having your buddies leave a comment for info (unless this is a buddy you know who does not care) leave a more generalized comment, or have them validate YOU and your leadership. 2) Do not have everyone say the same type of thing- change it up. Take your post and go to chatgpt, and say what are 20 comments my friends would leave that are engaging on this post on my personal facebook profile, the person will not be asking for info, asking to sign up, asking to order or talk in the DMs and will not be asking a question.
