The 9th Circuit Court ruled in October 2025 that the USDA cannot exempt ultra-processed foods from bioengineered (GMO) labeling even when companies claim the modified DNA becomes “undetectable” after heavy processing.
This directly hits staples like Heinz Ketchup. It uses high-fructose corn syrup and corn syrup made from U.S. corn crops over 90% genetically modified. One 1.32-liter bottle contains 92 grams of added sugar. That’s more than two full cans of Coca-Cola.
