Today, one of my carriers just realized they have a new factoring company they never signed an agreement with or consented to work with.
Apparently, many new carriers are having the same issues with this company named Fleetsmarts. They call you and ask you to get their fuel card and when you agree they will say,
"I also wanna let you know that for us to be able to open up a credit line for fuel, we do file what's called the UCC-1, which basically registers us with the state as a payee and allows us to open that fuel credit line with no credit checks needed, OK?"
And when you say, OK, they go ahead and file the UCC-1 and you realize later that now Fleetsmarts is your official factoring company by law and you can't get paid and work with any other factoring companies until and unless:
1- You ask them for a Letter of Release, paying them $500 for the processing fee;
OR
2- You decide to try them out and work with them.
They should say upfront, we are gonna file the UCC-1 which will make us your factoring company by law, so as not to confuse the layperson what's really going on. Watch out for this company, they'll really push you for that fuel card and then become your new factoring company! 😮
