The US Patent and Trademark Office has issued guidance stating that only natural human beings can be named as inventors on patent applications. While AI systems can assist with invention, the AI itself cannot be listed as an inventor. For an invention developed with AI assistance to be patented, a human must demonstrate that they made a significant intellectual contribution to the conception of the invention. The guidance aims to clarify patent eligibility in light of advanced AI technologies, but maintains that patents are intended to reward human ingenuity.
