Cold emailing in Canada (CASL) — Am I understanding this correctly?
Hey everyone,
I'm launching cold email outreach to HVAC companies in the Greater Toronto Area (Canada) and want to make sure I understand CASL compliance correctly.
From my research, here's my understanding:
**Canada (CASL) = Opt-IN model**
- Need consent BEFORE emailing
- But "implied consent" exists for B2B when:
- Email is publicly available on their business website
- Message is relevant to their business/role
- Implied consent lasts 2 years
**US (CAN-SPAM) = Opt-OUT model**
- Can email anyone
- Just need unsubscribe option
**My situation:**
- B2B outreach (not consumer)
- Emails scraped from public business websites
- Message is relevant (booking automation for HVAC companies)
- Low volume (~200/week)
- Unsubscribe link included
- Business contact info in signature
**My conclusion:** I should be fine under CASL's implied consent rules.
Am I missing anything? Anyone here running cold email campaigns in Canada who can share their experience?
