Brandon entered into a validly formed contract with Mejalee for the lease of a commercial office. The express terms of the lease state that the contract will only be executed provided that Brandon is able to get out of his current commercial office lease. Brandon is not able to get out of his current lease, although he made his best efforts to do so. Brandon notifies Mejalee that he will not be performing under the contract and will not lease the space. Mejalee sues Brandon for breach of contract. Will Mejalee be succeed on the merits of his case? Explain. Appreciated the discussion during office hours this last week fellas. Keep up the great work! πŸ’ͺ🏼

Mejalee will not be able to succeed on the merits of the case. Brandon needing to get out of his old contract is a condition precedent. This must be completed first, in order for the contract to work. Since this was an express term of the contract, and Brandon acted in good faith and gave his best efforts to exit his current contract, Mejalee will not be successful.
