AI Regulation in the US
Three dates tell the whole story of AI regulation in America. May 2024: Colorado signs the first real state AI law. May 2026: the governor signs SB 189 and removes its core requirements. January 2027: the new date for whatever is left. A law with teeth became disclosure paperwork before a single company had to comply. NVDIA and Open AI are making AI Chips. What they made will blow your mind.
Three companies built their own AI chips to reduce their dependency on NVIDIA. This week OpenAI became the fourth. OpenAI and Broadcom built a custom AI chip called Jalapeno. Engineering samples were physically delivered to OpenAI's San Francisco headquarters by Broadcom's CEO. The pattern here is worth paying attention to: Google built TPUs in 2015 Amazon built Trainium. Apple built M-series silicon. Every one of those moves was about the same thing: controlling cost and supply chain at scale instead of paying NVIDIA's prices. NVIDIA holds roughly 80% of the AI chip market, and the prices reflect that. Once Jalapeno is in production, OpenAI gains real leverage over its infrastructure costs for the next three years. That matters for anyone watching the long-term dynamics between OpenAI and NVIDIA. The bigger lesson applies to every business: when a single vendor controls your most important input, you either build an alternative or you accept their pricing forever. Executive Order for AI
Your AI model might need NSA clearance before it ships. That is the direction after last week's executive order. It hands the NSA the job of defining what counts as dangerously powerful AI and building the benchmark that decides which models get government oversight before release. The voluntary part: AI developers can give federal agencies 30 days of pre-release access to evaluate new models. Not a legal requirement yet. The word doing all the work in that sentence is "yet." This is the beginning of the conversation, not the end. Government is now in AI to an extent we have not seen before. Where do you land?
