PLO Tax Implications?
Hi all, I have seen mention many times the strategy of using a PLO to take control of a property from an existing landlord, paying the mortgage and everything else, leaving them as though they no longer have a property. However, what I would like to know is: what is the tax implications for said landlord if the property is in their own name? (Asking for a friend!) My understanding is that even though they don't see any benefit, HMRC still considers the rent obtained as being their income. If this is true then it could put them in a tricky situation. However, it's quite likely that I've gotten this wrong. Can anyone here clarify this for me with any authority?

@Clare Dix thanks Clare, but I would take anything ChatGPT says with a pinch of salt. However in this case it looks to be correct as I’ve just had it confirmed by a CTA.

@Rodney Brown not sure tbh. I wish I was the sort of person who could just shrug and say that it's their problem, but I'm not like that. I've gone back to the CTA to ask if there's any other way around this for the seller.
Legal Advice Urgently Needed Please
My brother Doron Howard has stolen all of my late mother's estate through trickery. He has put "nuts and braces" on it by gaining our trust and thus we signed anything he put in front of us saying "the properties and banks are abroad, you are in England I will take care of everything and I will give you your inheritance, every last penny; you know you can trust me" we had not idea he would then indeed take everything for himself. We now face a potential legal battle, my sister Larena and I trusted him as he was our brother. We now feel sad and at a loss. Does anyone have any advice on such a situation? Our late mother also had monies in Banks in England but we have none of these details as Doron is now conveniently no longer communicating with us. Doron has bought several properties in Edgware, Manchester and he even has take my father's family home in Leadale Road N16 9DG on to his SOLE name. My mother's estate was worth over 10 million pounds. There is much more to say but we now need legal advice I am told as Doron is refusing to keep his promises to us.

I've been in a similar situation (although not to the same extent!), and having sought legal advice and spoken to numerous organisations which are supposed to be there to help you (they aren't!) the main quote which kept coming back to me was "it happens all the time". Basically, unless you can afford the legal fees, you're on a hiding to nothing. Sorry, I know that's not what you want to hear, but I recommend you speak to a lawyer who specialises in family litigation and see if they can find a way through for you. I wish you luck and sincerely hope you you get a good result.
HMO Deal - Help Needed
Hi gang! I need help with a new deal as I'm missing some key elements and hope someone here can fill me in. I have a 3-bed property with lapsed planning permission for a two storey side extension and a loft conversion. This would make a marvellous 6-bed HMO. Market Value is currently £325k-£350k. Purchase Price is £250k including all fees and tax. Local HMO rooms are going for around £700pcm but they're nothing special. Post conversion, looking at income of around £5400 pcm (6 x £900 as going for 'high end'). I would like to build: - 2-storey side extension (approx. 3.5m x 7.5m), providing two large bedrooms with en-suites. - Loft conversion, providing large bedroom, en-suite and separate plant room. - Single storey rear extension (approx. 2m x 8m), extending the existing kitchen and dining room and providing a separate utility and toilet to one side (behind side extension). What I would like to know is: - Am I correct in saying that a 2-storey side extension is not covered under PD so will require planning? - What ball-park figures should I expect for the conversion? - Typical timescales? - How do I calculate the 'commercial' value based on the HMO revenue? - Is somebody willing to JV on this? I'm specifically talking about cash for the conversion. Thanks in advance for any help. Regards, Paul.

Turns out that the valuation is typically around 8-10 times the gross annual rent.
New rental law
Hi Liam, I went to see an estate agent yesterday as an exercise to your lessons and the guy sitting in letting dept told me from September new law is being introduced and you won't be able to do ac3 Yr rental contract and it willv9nly be 1 month contract. I asked him what about the contracts I have already signed and he says that contract will not be valid from September and one can the property on one month's notice. Is that true

Technically he's right. The Renter's Right Bill abolishes all ASTs, and all tenancies will revert to Periodic tenancies, including existing tenancies. Tenants will be able to give 1 months notice. Landlords will not be able to end the tenancy without the tenant's agreement (unless they break the contract in some way). But this is for tenants. It won't affect R2R agreements directly as those are technically management contracts. However, it does raise questions around the whole R2R strategy. R2R should still be good for SA and HMO to some extent due to the nature of the people who opt for HMO, but single lets could get messy. I'd be interested in the Mentors' thoughts on how this will affect things.
