In lay-peoples term, what does this mean? "This Probable Cause was drafted by Det. J.M. #391 and only submitted by Det N.R. due to technical issues" So, 1 guy drafted/created the Probable Cause Affidavit, but someone else took it over as the Arresting Officer or Senior Officer? Det N.R. is the one submitting this draft to the S.A.'s Office..The Bidding begins and the Bonds are created?🤔

Make sure you check your state rules and procedures but for the most part. A law enforcement officer provides the probable cause affidavit, which is a sworn statement detailing facts and circumstances supporting an arrest or search. A judge then reviews this affidavit to determine if sufficient probable cause exists for the issuance of an arrest or search warrant, or for further legal action. The Role of the Officer Gather Evidence: The officer's primary role is to gather objective facts and evidence that suggest a crime has been committed. Write the Affidavit: They then write the affidavit, which is a summary of these facts and their opinion on the evidence. Swear to the Truth: The officer swears an oath that the information in the affidavit is true. The Role of the Judge Review the Affidavit: A judge reviews the probable cause affidavit to ensure there are legitimate reasons for the police action. Determine Probable Cause: The judge makes the final determination on whether there is enough evidence to establish probable cause. Issue Warrants: If probable cause is established, the judge may issue an arrest warrant or a search warrant. Key Points Sworn Statement: The document is a sworn statement, meaning the officer is legally accountable for its accuracy. Objective Facts: It must contain objective facts and evidence, not just subjective suspicions or hunches, according to Justia. Judicial Oversight: The process ensures constitutional rights are protected by having a neutral magistrate or judge oversee police actions.

Using the information from our Classroom, I searched the process for a Grand Jury Indictment and how it plays out...Especially since this is labeled a "Capital Felony" After a grand jury indictment(9/16), the court proceeds with an arraignment(Monday 9/22) where the defendant enters a plea, followed by pre-trial proceedings including discovery, motions, and potential plea bargaining. If no plea is reached, the case moves to a jury trial, culminating in sentencing if the defendant is found guilty. The time frame varies significantly, from a few months to several years, depending on the case's complexity and court schedules. Immediate Steps After Indictment 1. Filing of the Indictment: The grand jury formally files the indictment with the court.  2. Arrest: A warrant is issued, and the defendant is arrested or brought to court. 8/13-Arrested 3. Initial Appearance: The defendant makes an initial appearance-8/14 before a judge, where their rights are reviewed, and release conditions are set.  4. Arraignment: The defendant appears in court, the indictment is read, and they enter a plea (guilty or not guilty).  Pre-Trial Phase - Discovery: - Plea Bargaining: - Motions

You need to have your daughter ask for her full discovery, sworn affidavit of the person. Or persons accusing her or request copy of their disposition 6th amendment is violated if they can't and don't produce. Get full copy of the indictment make sure you look the charges up and research the elements to prove the charges DON'T EVER take a deal.....
