However, a will generally must go through probate court and may become part of the public record. A trust can hold properly transferred assets, provide more control over when and how beneficiaries receive an inheritance, offer greater privacy, and help certain assets avoid probate. But a trust only works as intended when it is properly created, signed, funded, and maintained. Having the document alone is not enough. And doing nothing is still a decision.
