Do I owe this alleged overpayment due to my remarriage? I had a marriage that lasted 22 years. We got divorced in 2003. I was receiving my own benefits since I was 62. When my ex-spouse started taking his benefits (I believe it was 2017) I also started getting divorced spouse benefits of about $100/mo in addition to mine. Fast forward to 2022. I have been seeing a great guy since 2006. He wants to get married. I called SSA and explained the situation. My first marriage was long enough, I was over 60 years old and had been divorced more than two years. I was told that my remarriage would not stop my divorced spouse payment. She stated after 60, a new marriage didn't count. We got married on 8/6/2022. On 8/8/22, I called SSA and advised them I had remarried. The service rep congratulated me. I asked if I needed to send my marriage certificate? She said no, she would note the file, but since it did not affect my benefits, she didn't need the certificate. She said I might want to check on Advance Designee. On 8/8/22 I changed my AdvanceDesignation of Representative Payee to my new husband and relationship is listed as spouse on that form. That is the last time it was updated. Early this year, I got a letter from SSA claiming they overpaid me $5452- and they wanted me to pay it back within 30 Days. In my opinion, its not my fault, and I did notify them, at least by phone and by the Designee form. I already had a meeting, then they sent another letter denying my appeal, then I sent the next appeal and request for waiver, and now I have about two more weeks to respond to the third denial. Please answer as soon as possible.
