Hey everyone. I’m working with my attorney on an heir interest purchase contract. We’re incorporating the upfront/backend payment structure into the contract. To those who use this payment structure, do you have anything in your contract that guarantees the heir’s backend payment on a certain date? Since the backend payment is payed once the buyer sells the property, what’s stopping the buyer from just holding onto the property indefinitely and never paying the backend payment? I want to address this when pitching to heirs. Thanks!
