برخورد با بیحجابی و فعالیت در فضای مجازی تشدید میشود
دادستان تهران از فعالیت «دادسرای ویژه امنیت اخلاقی» با ۱۲ قاضی و راهاندازی واحدی برای رصد مستمر فضای مجازی خبر داده است. علی صالحی گفته موارد مورد نظر بهطور مداوم شناسایی میشوند و برخورد با آنها نیز بلافاصله صورت خواهد گرفت.
او در همین زمینه از بازداشت یک زن و مرد به دلیل انتشار کلیپی خبر داده که از سوی مقامهای قضایی «تمسخر مراسم اربعین» توصیف شده است. به گفته دادستان تهران، علاوه بر بازداشت این دو نفر، حسابهای آنها نیز مسدود شده است.
صالحی همچنین از ادامه برخورد با کافهها، رستورانها و فروشگاههایی سخن گفته که فعالیت آنها از منظر دادستانی با ضوابط مورد نظر در حوزه «امنیت اخلاقی» مغایرت دارد. او تاکید کرده است که این نظارتها و برخوردها به شکل مستمر ادامه خواهد یافت.
دادبان تاکید میکند، صرف انتشار محتوا در فضای مجازی یا انتخاب نوع پوشش نمیتواند بدون وجود نص صریح قانونی و تحقق عناصر یک جرم، مبنای بازداشت، مسدود کردن حسابها یا اعمال محدودیت علیه شهروندان قرار گیرد. اصل قانونی بودن جرم و مجازات نیز ایجاب میکند که عناوین مبهمی مانند «امنیت اخلاقی» به ابزاری برای توسعه دامنه مداخله کیفری در زندگی خصوصی و آزادی بیان تبدیل نشوند.
برخورد با پوشش، سبک زندگی، فعالیت کسبوکارها و محتوای منتشرشده در فضای مجازی پیشتر نیز به یکی از شیوههای اعمال فشار اجتماعی بر شهروندان تبدیل شده است. گسترش رصد دائمی و برخورد قضایی در این حوزه، نشانگر تبدیل دستگاه کیفری به ابزاری برای کنترل رفتارهای روزمره و سرکوب اجتماعی است و حریم خصوصی و آزادیهای فردی را بیش از پیش محدود میکند.

Clash with non-veiling and cyberspace activities to be intensified
The Tehran Prosecutor's Office has announced the activity of a "Special Moral Security Prosecutor's Office" with 12 judges and the launch of a unit for continuous monitoring of cyberspace. Ali Salehi said that the cases in question are continuously identified and will be dealt with immediately.
In this context, he announced the arrest of a man and a woman for publishing a clip that judicial authorities described as "mocking the Arbaeen ceremony." According to the Tehran Prosecutor's Office, in addition to the arrest of the two people, their accounts have also been blocked.
Salehi also spoke of continuing to deal with cafes, restaurants, and stores whose activities, from the prosecutor's perspective, are inconsistent with the criteria set forth in the field of "moral security." He emphasized that these monitoring and dealings will continue on an ongoing basis.
The judge emphasizes that the mere publication of content in cyberspace or the choice of the type of coverage cannot be the basis for arrest, blocking accounts, or imposing restrictions on citizens without an explicit legal text and the fulfillment of the elements of a crime. The principle of the legality of crime and punishment also requires that vague titles such as “moral security” not become a tool for expanding the scope of criminal interference in private life and freedom of expression.
Dealing with coverage, lifestyle, business activities, and content published in cyberspace has already become one of the methods of exerting social pressure on citizens. The expansion of constant monitoring and judicial action in this area indicates that the criminal system has become a tool for controlling everyday behavior and social repression, and it further restricts privacy and individual freedoms.
