We just found out today that we won a case on appeal for an employer we represent. They had fired an employee for misconduct, but when he filed for unemployment benefits, EDD awarded him benefits and charged the employer.
We reversed that. We had to define the legal definition of “misconduct” then use EVIDENCE to prove his actions met that legal standard.
